An NRI, or Non-Resident Indian, refers to any Indian citizen living outside of India who has spent less than 182 days in the country during the previous financial year. Despite being away from India, NRIs still possess opportunities to invest in real estate within the country.

A Person of Indian Origin (PIO) is an individual who has either held an Indian passport at any point, or whose parents or grandparents were Indian citizens in accordance with the Constitution of India or the Citizenship Act of 1955.
Certainly! A Person of Indian Origin (PIO) has the eligibility to purchase property within India.
Yes, a non-resident Indian can buy either a residential property or a commercial property in India. There is no limit on the quantity of properties that an NRI can purchase in India. Exception: Agricultural land, plantation land or a farm house in India are properties an NRI can NOT buy. He cannot even acquire such property as a gift. He can inherit this property.
You do not need permission from the RBI to purchase residential or commercial property.
Under the Indian Income Tax Act, only one house property is considered self-occupied, exempt from tax. Additional properties are treated as rented, incurring tax on deemed rental income, regardless of actual rental status, computed according to tax regulations’ prescribed valuations.
NRIs and overseas citizens of India OCIs can freely purchase or sell properties like houses in India without needing prior approval, as per the Reserve Bank of India (RBI).
Under general permission, Non-Resident Indians (NRIs) and Persons of Indian Origin (PIOs) can freely buy property in India. NRIs are Indian citizens living abroad, while PIOs are individuals not from specific countries with ties to India. This permission is limited to residential and commercial property purchases.
Your level of education and chosen profession can influence your eligibility for loans. For instance, in India, only NRIs with a graduate degree are eligible for home loans.
  • When purchasing an under-construction property, developers might request a power of attorney (PoA) in their favor, simplifying the documentation process.
  • PoA grants authority for various transactions like contracts, deeds, mortgages, or sales. Ensure clarity and legality by consulting a trusted lawyer for proper wording and understanding of authority granted.
NRIs need to file income tax returns for investments if:

  • Taxable income in India during that year was above 1.6 lakhs.
  • Short-term or long-term capital gains from sale of investments or assets were made (even below 1.6 lakhs).
Some of the assets which don’t fall under CGT include:

  • Capital gains invested in NHAI bonds or in Rural Electrification Corporation.
  • If long-term capital gains from the sale of a house is invested in buying another house. In such cases, the amount exempted is either the amount of capital gains or the amount invested in buying the new house, whichever is lower.
